Please read these Terms of Service carefully before using Spine33 Rehab. By accessing or using our Platform, you agree to be bound by these terms.

1. ACCEPTANCE OF TERMS

By accessing or using the website located at spine33rehab.com (the "Website"), you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, our HIPAA Notice of Privacy Practices, and our Cookie Policy. These Terms constitute a legally binding agreement between you and Spine 33 Rehab PLLC ("Spine 33 Rehab," "we," "us," or "our"), a Tennessee Professional Limited Liability Company.

If you do not agree to these Terms in their entirety you must immediately discontinue use of this Website. We reserve the right to modify these Terms at any time. Continued use of the Website following any modification constitutes your acceptance of the revised Terms. The most current version of these Terms will always be posted at spine33rehab.com/terms-of-service with the Last Updated date reflecting the most recent revision.

2. DESCRIPTION OF SERVICES

Spine 33 Rehab PLLC is a telehealth physical therapy practice providing the following services to eligible patients.

Virtual physical therapy evaluations delivered via HIPAA-compliant video telehealth platform. Follow-up virtual physical therapy sessions for established patients. Asynchronous messaging subscription services providing clinical guidance between scheduled appointments. Self-paced digital educational courses focused on spinal rehabilitation and spine health. Free discovery calls for prospective patients to determine appropriateness of telehealth PT services.

All clinical services are provided exclusively by Connor Sheeks PT DPT, a licensed Doctor of Physical Therapy, or by other licensed physical therapists employed or contracted by Spine 33 Rehab PLLC who hold active licensure or PT Compact Privilege in the state where the patient is physically located at the time of service.

3. ELIGIBILITY

To use our clinical services you must meet all of the following eligibility requirements.

You must be 18 years of age or older. Individuals under 18 may only receive services with the express written consent of a parent or legal guardian who assumes full responsibility for the minor's participation.

You must be physically located in a state where Spine 33 Rehab PLLC holds active physical therapy licensure or PT Compact Privilege at the time of service. Current licensed states are available upon request at info@spine33rehab.com.

You must have reliable internet access and a device with a functioning camera and microphone capable of supporting HIPAA-compliant video telehealth sessions.

You must not be experiencing a medical emergency. If you are experiencing a medical emergency call 911 or go to your nearest emergency room immediately.

You must be an appropriate candidate for telehealth physical therapy as determined by your provider during your initial evaluation. Spine 33 Rehab PLLC reserves the right to decline or discontinue services for any patient determined to be an inappropriate candidate for telehealth delivery.

4. PROVIDER-PATIENT RELATIONSHIP

A provider-patient relationship with Spine 33 Rehab PLLC is established only upon mutual consent and mutual communication between you and your provider as required under Tennessee Code Annotated Section 63-1-155 and applicable telehealth law. A provider-patient relationship is NOT created by visiting this Website, reading its content, downloading free resources, or subscribing to our email list.

The provider-patient relationship and its associated duties and obligations do not arise until your provider affirmatively undertakes to evaluate, diagnose, or treat you following completion of all required intake documentation and informed consent forms.

Browsing this Website, viewing our educational content, or communicating with us via our contact form does not constitute clinical advice, diagnosis, or treatment and does not create any clinical obligations on the part of Spine 33 Rehab PLLC or its providers.

5. TELEHEALTH INFORMED CONSENT

Prior to your first appointment you will be required to complete and sign a Telehealth Informed Consent form through our HIPAA-compliant practice management platform, SimplePractice. This consent form explains the nature of telehealth services, the benefits and limitations of virtual physical therapy delivery, your rights as a telehealth patient, the technical requirements for participation, and the standard of care applicable to telehealth PT services under Tennessee law.

You acknowledge that telehealth physical therapy is held to the same standard of professional practice as in-person physical therapy under Tennessee Code Annotated Section 63-1-155 and that your provider will exercise the same clinical judgment and professional standards in a virtual setting as they would in a traditional clinical environment.

6. SCOPE OF PRACTICE AND CLINICAL LIMITATIONS

Spine 33 Rehab PLLC provides licensed physical therapy services within the scope of physical therapy practice as defined by applicable state law. We do not provide medical diagnosis, prescribe medications, order imaging studies, perform invasive procedures, or provide any services outside the licensed scope of physical therapy.

Telehealth physical therapy has inherent limitations compared to in-person care. Your provider cannot perform hands-on manual therapy, use physical modalities, or directly physically assess you in the same manner as an in-person visit. By agreeing to telehealth services you acknowledge and accept these inherent limitations.

If your condition requires services outside the scope of telehealth physical therapy your provider will inform you and assist you in identifying appropriate referral resources. Spine 33 Rehab PLLC is not responsible for any outcomes resulting from conditions that require in-person assessment, medical evaluation, or emergency care.

7. FEES AND PAYMENT

All services provided by Spine 33 Rehab PLLC are offered on a cash-pay, self-pay basis. We do not bill health insurance companies directly. Patients may submit superbills to their insurance company for potential reimbursement at their own discretion and we make no representations regarding insurance reimbursement outcomes.

Current service fees are listed on our Services page at spine33rehab.com/services. Fees are subject to change at any time with notice provided through our Website or direct patient communication.

Payment is required at or before the time of service for all evaluations and individual follow-up visits. Subscription services are billed monthly on a recurring basis until cancelled. Visit packages are billed in full at the time of purchase.

All payments are processed through SimplePractice's secure payment platform powered by Stripe. We accept all major credit cards, debit cards, and HSA and FSA cards. HSA and FSA cards are accepted as physical therapy is a qualified medical expense under IRS Publication 502.

Missed appointments or late cancellations within 24 hours of the scheduled appointment time may be subject to a cancellation fee as specified in your intake documentation. This fee will be disclosed in your Financial Policy provided during intake.

8. GOOD FAITH ESTIMATES

In accordance with the No Surprises Act and its implementing regulations, Spine 33 Rehab PLLC provides a Good Faith Estimate of expected service costs to all uninsured and self-pay patients prior to the first scheduled service. Your Good Faith Estimate will be delivered through your SimplePractice client portal as part of your intake documentation.

If your actual charges exceed your Good Faith Estimate by more than $400 you have the right to dispute the bill through the patient-provider dispute resolution process. For questions about your Good Faith Estimate please contact info@spine33rehab.com.

9. CANCELLATION AND REFUND POLICY

Appointment Cancellations Appointments may be cancelled without penalty with at least 24 hours advance notice through your SimplePractice client portal or by contacting info@spine33rehab.com. Cancellations made less than 24 hours before a scheduled appointment may be subject to a late cancellation fee as specified in your Financial Policy.

Subscription Cancellations Monthly subscription services may be cancelled at any time by providing written notice to info@spine33rehab.com. Cancellation requests received before your next billing date will prevent the subsequent charge. No partial month refunds are issued for subscription services.

Visit Package Refunds Unused sessions from a purchased visit package may be refunded on a pro-rata basis within 30 days of the original purchase date. After 30 days visit packages are non-refundable but unused sessions remain valid for 6 months from the date of purchase.

Digital Course Refunds Digital courses are non-refundable once course content has been accessed. If you have not accessed any course content a full refund may be requested within 7 days of purchase by contacting info@spine33rehab.com.

Evaluation Refunds Completed evaluations are non-refundable. If you are determined to be an inappropriate candidate for telehealth PT during your evaluation a partial refund may be offered at the discretion of Spine 33 Rehab PLLC.

10. INTELLECTUAL PROPERTY

All content on this Website including but not limited to text, graphics, logos, images, blog articles, course materials, videos, audio content, home exercise programs, clinical protocols, and the Spine 33 Rehab brand name and logo are the exclusive intellectual property of Spine 33 Rehab PLLC and are protected by United States copyright, trademark, and other intellectual property laws.

The Spine 33 Rehab name and logo are claimed trademarks of Spine 33 Rehab PLLC. Unauthorized use of our trademarks in connection with any goods or services is prohibited.

You may not reproduce, distribute, modify, create derivative works from, publicly display, republish, download, store, or transmit any content from this Website without the prior express written permission of Spine 33 Rehab PLLC. Personal non-commercial use of Website content for your own educational purposes is permitted provided you do not remove any copyright or proprietary notices.

Course materials, home exercise programs, and clinical content provided to patients during their care are licensed for personal use only and may not be shared, reproduced, or distributed without prior written consent.

11. USER CONDUCT

By using this Website you agree not to engage in any of the following prohibited activities.

Using this Website for any unlawful purpose or in violation of any applicable federal, state, or local law or regulation. Attempting to gain unauthorized access to any portion of the Website, any other system or network connected to the Website, or any SimplePractice server. Transmitting any unsolicited commercial communications, spam, or chain letters through our contact forms or email systems. Impersonating any person or entity or misrepresenting your affiliation with any person or entity. Interfering with or disrupting the integrity or performance of the Website or its content. Collecting or harvesting any personally identifiable information from the Website. Using any automated means including robots, spiders, or scrapers to access, query, or index the Website. Submitting false, misleading, or fraudulent information through any form or intake process on the Website.

12. THIRD PARTY LINKS AND SERVICES

This Website may contain links to third party websites and services including but not limited to our SimplePractice client portal, Kit email marketing platform, social media platforms, and external educational resources. These links are provided for your convenience only.

Spine 33 Rehab PLLC does not endorse, control, or assume responsibility for the content, privacy practices, or terms of any third party website or service. Your use of any third party website or service is governed by that party's own terms and policies. We encourage you to review the terms and privacy policies of any third party site you visit.

13. DISCLAIMER OF WARRANTIES

This Website and all content contained herein are provided on an as-is and as-available basis without warranties of any kind, either express or implied. Spine 33 Rehab PLLC expressly disclaims all warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

The educational content on this Website is provided for general informational purposes only and does not constitute medical advice, clinical diagnosis, or individualized treatment recommendations. Spine 33 Rehab PLLC makes no representations or warranties regarding the accuracy, completeness, or applicability of any content on this Website to your specific health condition.

We do not warrant that this Website will be uninterrupted, error-free, or free of viruses or other harmful components.

14. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Spine 33 Rehab PLLC, its members, officers, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages including but not limited to damages for loss of profits, goodwill, data, or other intangible losses arising out of or relating to your use of or inability to use this Website or its content.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or your use of this Website shall not exceed the amount you paid to Spine 33 Rehab PLLC in the twelve months preceding the claim.

Nothing in these Terms limits or excludes our liability for gross negligence, intentional misconduct, or any liability that cannot be limited or excluded under applicable law.

15. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Spine 33 Rehab PLLC and its members, officers, employees, contractors, and agents from and against any and all claims, damages, losses, costs, and expenses including reasonable attorneys fees arising out of or relating to your use of this Website, your violation of these Terms, or your violation of any rights of any third party.

16. HIPAA AND PATIENT RIGHTS

As a covered entity under the Health Insurance Portability and Accountability Act of 1996, Spine 33 Rehab PLLC is committed to protecting the privacy and security of your protected health information. Your rights as a patient regarding your health information are described in our HIPAA Notice of Privacy Practices available at spine33rehab.com/hipaa-notice.

These Terms of Service govern your use of our Website and do not supersede or replace our HIPAA Notice of Privacy Practices with respect to the use and disclosure of protected health information.

17. GOVERNING LAW AND DISPUTE RESOLUTION

These Terms shall be governed by and construed in accordance with the laws of the State of Tennessee without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of this Website that cannot be resolved through good faith negotiation between the parties shall be submitted to binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The arbitration shall take place in Shelby County, Tennessee or remotely by mutual agreement. The decision of the arbitrator shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction in Shelby County, Tennessee to prevent irreparable harm pending arbitration.

You waive any right to bring claims as a plaintiff or class member in any class action, class arbitration, or representative proceeding.

18. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable or severed from these Terms if modification is not possible. The remaining provisions of these Terms shall continue in full force and effect.

19. ENTIRE AGREEMENT

These Terms of Service together with our Privacy Policy, HIPAA Notice of Privacy Practices, Cookie Policy, and Good Faith Estimate Notice constitute the entire agreement between you and Spine 33 Rehab PLLC with respect to your use of this Website and supersede all prior agreements, representations, and understandings of any kind relating to the same subject matter.
